How to address someone using their phone while driving

On Behalf of | Aug 19, 2024 | Injuries, Motor Vehicle Accidents

Many drivers know the dangers of using a phone while driving, yet it remains a pervasive problem. It could be a quick glance at a text, navigating with GPS or answering a call. These distractions can have fatal consequences.

Tragically, distracted driving was responsible for over 3,000 fatalities in 2022. So, when you notice a driver using their phone behind the wheel, it is important to address the situation carefully.

Addressing the issue with care

In New Jersey, using a handheld phone while driving is illegal. The law prohibits texting, talking or using any handheld device. Take the steps if you encounter a driver who uses their phone while driving:

  • Keep a safe distance from the distracted driver.
  • Note the vehicle’s description, license plate and location.
  • If possible, have a passenger report the driver to local authorities.
  • Never attempt to confront the driver directly while on the road.
  • Pull over safely if you need to report the incident yourself.

It is crucial to note that drivers may use hands-free devices, but even then, it is best to keep distractions to a minimum.

The state has imposed strict penalties for violators, including fines and potential license suspensions for repeat offenders. Still, distracted driving remains a significant problem on New Jersey roads.

Taking legal action when injured

If injured in an accident caused by a distracted driver, get treatment immediately, regardless of if the injury seems minor. If able, take photos of the scene, the vehicles and any visible injuries. You will need all these when you file a personal injury claim.

A successful personal injury lawsuit enables you to obtain compensation for medical treatment, lost income due to time off work and emotional distress or physical discomfort caused by the injury. The repercussions of distracted driving can be significant, making it essential to hold individuals accountable for their actions.
